Could it be that the ‘macob moment’ for adjudication in Ireland is now close?
Conspicuously, since the Construction Contracts Act 2013 came into force in 2016, nearly four years ago, there has not been a challenge to the enforcement of an adjudicator’s decision. But times have changed. We are now in a Covid-19 environment which has resulted in unprecedented uncertainty. This article suggests that in these straightened times it is likely that more marginal adjudication cases will now be advanced, thus considerably increasing the latitude for the first challenge to the enforcement of an adjudicator’s decision.
